Nazool land means land which belongs to Government and includes buildings
standing on such land.
- An act to provide grant of land by Government called the J&K
Land Grants Act 1960 applicable to the whole state of J&K.
- Nazool (State Lands) can be alloted in Srinagar city in favour of people
within the radius area of 16 Kms,from Sherghari and in all towns and notified and such areas
as the Government may notify from time to time.
- Nazool land can be granted for residential , commercial
and Industrial purposes.
- Non-permanent residents /Non-State subjects can be granted nazool land
for Industrial and commercial purposes only subject to the specific
permission of the State Government.
- No plot of land granted for residential puposes shall exceed
2 kanals in the area.
- The land shall be granted after charging premium and ground
rent. The premium shall have to be fixed by the Government. Religious
and charitable Institutions can be alloted land by the government without charging premium.
- Government has a right to re-entry on expiry of lease or can
resume the land at any time if violations are made.
- The lessee cannot transfer the leased property in favour of any
person who-so-ever without the permission of the state government.Any such
illegal tranfer can result in resumption of the land by the government without compensation.
- The lease shall be alloted in the first instance for 40 years
and the maximum period of lease
shall be 99 years only, with each order of renewal for a certain time period
to be specifically authorised by the government.
- An allottee shall have to apply for grant of nazool land in
his/her favour giving details about his/her requirements.
- The land in question shall be identified by the field staff
and the nazool department.
- NOC shall be obtained from the SDA/Municipal authorities
before recomendation by the Nazool department for allotment.
- The case will be processed by the A.C. (Nazool) who in turn will
submit the case to the Deputy Commissioner and who in turn will submit the case to the Divisional Commissioner. The
Divisional Commissioner submits the case to the government through Financial Commissioner [ Revenue] with his/her recommendations/comments.
- In case the allotment of land is ordered by the Government the
lessee shall have to deposit the amount of premium as is determined by the government with the nazool
department and then enter into a lease agreement with the department under proper
Court procedure.
- After expiry of first lease period the lessee shall apply
in time for its renewal . The lease can be renewed subject to the conditions that no violations
have been made by him/her and he/she has deposited the rent with the Nazool
Organisation and the property is not required for any other public purpose
as may be determined by the government.
- In the event of resumption or acquisition of Nazool land and properties ,
the Lessee shall be entitled to compensation for the structures raised on the
land as may be determined by the government.
