Relief [Ex gratia]

Ex-Gratia Relief
  In the light of the Government Order No.723-GR of 1990 dated.10-7-1990 the ex-gratia relief shall be payable in respect of persons killed permanently/partially disabled or to those persons whose houses got damaged as a result of violence attributable to the breach of law and order or any other form of commotion.

PERSONS OTHER THAN GOVERNMENT EMPLOYEES

  • a) For death = Rs.1.00 lakh
  • b) for permanent disability = Rs.0.25 lakhs, Rs.0.75 lakhs ( w.e.f 6-1-1997)
  • c) For serious injury = Rs.0.05 lakh
  • d) For injury (Hospitalization) Less than 24 hours = Rs.0.01 lakh
  • e) For minor injury = Rs.500/-
  • f) Damage to immovable property Due to bomb blast or any other Kind of Sobatage 50% of the loss subject to upper Ceiling of Rs.1.00 lakh. The Assessment of loss shall be made By the Tehsildar concerned/Asstt. Commissioner /S.D.M. concerned.

SUBJECT TO THE FOLLOWING CONDITIONS:
 a) That the subject was not directly involved in any kind of subversive activity. In light of the Government Order No.1300-GAD of 1997 dated.19-8-1997 the following persons are also entitled for ex-gratia relief:

  • A) The families of surrendered militants who have been and may be killed as a result of violence attributable to the preach of law and order or any form of civil commotion are entitled for ex-gratia relief at the same rates as for civilians as indicated in the Government Order No.723-GR of 1990 dated.10-7-1990.
  • B) The ex-gratia relief is being sanctioned after completing all the formalities, and obtaining the surrender certificate from the concerned authorities before whom the deceased militant had surrendered.

  In light of the Government Order No.278-GAD of 1997 dated.26-2-1997 the civilians killed or who got permanently disabled on the International border/Line of Actual Control due to shelling/firing from across the line of control are entitled for ex-gratia relief on the same pattern as provided vide Government Order No.723-GD of 1990 dated.10-7-1990.

  In the light of the Government Order No.723-GD of 1990 dated.10-7-1990 read with Government Order No.1073-GR of 1990 dated.19-11-1990 the NOK's of the missing persons are also entitled for ex-gratia relief subject to the following conditions:

   1. A report of personal enquiry made by the District Magistrate of the concerned District about the circumstances in which the death of the concerned person can be reasonably presumed to have occurred.
    2. The recipient of the ex-gratia relief amount should furnish an indemnity band as well as surety bond of a person of substance to the satisfaction of the District Magistrate to the effect that the amount of ex-gratia relief shall be refunded in the event of subsequent event which proved that the death had not in fact taken place. In light of the Government Order No.723-GR of 1990 dated.10-7-1990 the ex-gratia relief is admissible in respect of personnel of para-military forces who are killed or are disabled in consequence of due performance of duties, the relief shall be sanctioned by the Government in the Home Department.

    The ex-gratia relief cases in respect of those persons who are reportedly hit and run by the army vehicles/non-civilians are being processed by the Sub-ordinate Revenue Agency and are finally submitted to the Home Department for favour of necessary sanction in favour of the NOK's of the deceased/injured persons.
